East Punjab Urban Rent Restriction (Extention to Chandigarh) Act, 1974 — East Punjab Urban Restriction Act, 1949 — Section 3 — The Administrator of Chandigarh in exercise of his power conferred upon him under Section 3 of the 1949 Act issued a notification dated 7.11.2002 whereby and where under it was directed that the provisions thereof would not apply to the buildings; monthly rent whereof exceeded Rs.1,500/- — Held, notification dated 7.11.2002 is not valid — Such exemption cannot be granted by an executive order issued under Section 3 — It can be granted only by way of an amendment — In the present case, it was not indicated how the criteria of Rs.1,500/- was fixed — Moreover, notification dated 7.11.2002 is invalid also on the ground that it is not for a limited period but will have a permanent effect.
