Oral dying declaration

Oral Dying Declaration — Oral dying declaration made by deceased Baburam before his brother Jhabbulal, in the present case, was disbelieved by the High Court on the ground that oral dying declaration was not mentioned by witness Jhabbulal either in his FIR or in his statement recorded under Section 161 of Cr.P.C. — Held, the High Court committed serious error in disbelieving the oral dying declaration made by deceased Baburam before his real brother Jhabbulal (PW1) implicating the appellants as his assailants — Criminal Procedure Code, 1973, Sections 32, 154 and 161.
