Election to the Gram Panchayat — Whether the Anganwari workers employed in the various social-welfare schemes in the State of Punjab held an ‘office of profit’ and consequently disqualified for seeking election to the Gram Panchayats? — Held, no — Circular Memo No. SEC-2008/4365 dated 30.4.2008, issued by the State Election Commissioner, Punjab is based on a misinterpretation of the law laid down by this Court in the cases of Shivamurthy and Ravanna Subanna and, is, therefore, quashed.

 
Election to the Gram Panchayat

Election to the Gram Panchayat — Whether the office of a Lambardar would be an ‘office of profit’ so as to disqualify the incumbent of such an office to seek election as Panch of the Gram Panchayat? — Held, no — High Court, in the present case, erred in holding that the office of Lambardars is an ‘office of profit and, therefore, the Lambardar would be disqualified from contesting the election — Further, Circular Memo No. SEC-2008/4365 dated 30.4.2008, issued by the State Election Commissioner, Punjab is based on a misinterpretation of the law laid down by this Court in the cases of Shivamurthy  [(1971) 3 SCC 870] and Ravanna Subanna (AIR 1954 SC 653) and, is, therefore, quashed — Appeal allowed — Judgment of the High Court is set aside, in so far as it relates to Lambardars — Panchayati Raj Act, Section 208 — State Election Commission Act, Section 11 — Constitution of India, 1950, Articles 243F(1) and 309 — Punjab State Legislature (Prevention of disqualifications) Act, 1952, Section 2(a) — Punjab Land Revenue Rules, Rules 20 and 21.
