Judgments on Lambardar

Wednesday, November 10, 2010

Lambardar — Office of a Lambardar would not be an ‘office of profit’.

Lambardar — Since the Lambardar is not holding any post under the Government, no salary is payable to him — There is no pay scale attached to the office of Lambardar — Therefore, it cannot be said that he is in receipt of any remuneration.

Lambardar — In the case of Mahavir Singh Vs. Khiali Ram & Ors. [(2009) 3 SCC 439] this Court has held that :

“Although the post of Lambardar is governed by the provisions of the Punjab Land Revenue Act and the Rules framed thereunder, holder of the said post is not a government servant. He does not hold a civil post within the meaning of Article 309 of the Constitution of India.”
