Suit for eviction or recovery of possession — Plaintiff/respondent filed suit for eviction — Plaintiff/respondent failed to prove the relationship of landlord and tenant — However he succeeded to prove his ownership/general title over the suit premises — Question arose — Was, in the aforementioned situation, a suit for recovery of possession maintainable? — Adjudged — The landlord in a given case although may not be able to prove the relationship of landlord and tenant, but in the event he proves his general title, may obtain a decree on the basis thereof — But in a case of this nature, a defendant was entitled to raise a contention that he had acquired an indefeasible title by adverse possession.
