Amendment in the pleadings — Amendment in the pleadings is a matter of procedure — Grant or refusal thereof is in the discretion of the court. But like any other discretion, such discretion has to be exercised consistent with settled legal principles.

Amendment of Pleadings

Amendment of pleadings — Held, there cannot be any doubt or dispute that the courts should be liberal in allowing applications for leave to amend pleadings but it is also well settled that the courts must bear in mind the statutory limitations brought about by reason of the Code of Civil Procedure (Amendment) Acts; the proviso appended to Order VI Rule 17 being one of them — Civil Procedure Code, 1908, Order 16, Rule 17.
